Terms of Service

Please read these Terms of Service (“Terms”) carefully before using the ClearJob mobile application or the clearjob.app website operated by Brown Consulting LLC d/b/a ClearJob (“ClearJob,” “we,” “us,” or “our”).
By accessing or using ClearJob, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the service.
1. Description of Service
ClearJob is a job management application designed for contractors, crews, and trade businesses. The service includes tools for creating quotes and estimates, scheduling jobs, generating invoices, collecting payments, and communicating with customers.
ClearJob is currently in development. Features and availability may change without notice during this period.
2. Eligibility
You must be at least 18 years old and capable of forming a legally binding contract to use ClearJob. By using the service, you represent that you meet these requirements.
3. Account Registration
To use ClearJob, you must create an account and provide accurate, complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate these Terms or that we determine, in our sole discretion, are being used inappropriately.
4. Acceptable Use
You agree to use ClearJob only for lawful purposes. You may not:
- Use the service to send spam, unsolicited messages, or harassing communications
- Impersonate any person or entity
- Upload or transmit malicious code or content
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use the service in any way that violates applicable federal, state, or local laws
- Resell or sublicense access to the service without our written consent
5. SMS Messaging
If SMS messaging is enabled for your ClearJob account, ClearJob may let you send transactional, service-related SMS notifications to your customers on your behalf. These messages may include estimate links, invoice links, payment receipts, appointment confirmations, arrival windows, running-late notices, and job status updates. ClearJob SMS may only be used for transactional and conversational communications related to an existing customer relationship. ClearJob SMS is not for marketing blasts, lead generation, third-party offers, or affiliate promotional messaging.
By using SMS features, you agree to:
- Obtain the recipient's prior express consent before sending SMS messages through ClearJob
- Keep SMS consent tied to the specific customer relationship and service request
- Comply with all applicable laws and regulations governing commercial SMS communications, including the TCPA (Telephone Consumer Protection Act)
- Only send messages related to services your customers have requested or agreed to receive
- Honor opt-out requests promptly, including STOP replies
Customers may provide consent by requesting service, submitting a service request, scheduling an appointment, checking an SMS consent checkbox, signing an estimate, or otherwise expressly agreeing to receive transactional text messages related to their service request before SMS is sent.
You are solely responsible for ensuring that your use of ClearJob's SMS features complies with applicable law. ClearJob is not liable for any claims arising from your SMS communications with customers.
Message frequency varies based on job activity, customer communication settings, and the number of estimates, invoices, appointments, receipts, or status updates sent. Message and data rates may apply. Customers can reply STOP to opt out of SMS messages or HELP for help. Recipients who opt out will no longer receive SMS messages unless they subsequently opt back in. Carriers are not liable for delayed or undelivered messages. Mobile phone numbers, SMS consent, and SMS opt-in data are not shared, sold, rented, released, or transferred to third parties, affiliates, or lead generators for marketing or promotional purposes. 6. Payments and Billing
ClearJob integrates with Stripe for payment processing. By using payment features, you agree to Stripe's terms of service in addition to these Terms. ClearJob does not store your full payment card information.
Pricing for ClearJob subscriptions (when available) will be disclosed clearly before any charges are made. All fees are non-refundable unless otherwise stated.
7. Beta Incentives
ClearJob may offer beta incentives to accepted beta testers. Unless otherwise stated, accepted beta testers receive free access during the beta period. The first 20 active beta testers may receive 3 months of free ClearJob service after public launch. The top 2 contributing beta testers may receive 1 year of free ClearJob service after public launch.
“Active beta tester” means an accepted beta tester who installs the app, uses the guided beta workflow, and provides feedback. “Top contributing beta testers” are determined solely by ClearJob based on the usefulness, specificity, and meaningfulness of feedback provided, including whether the feedback is incorporated into or materially informs the final application. ClearJob's determinations are final. Beta incentives have no cash value, are non-transferable, and may be modified or discontinued if the beta program changes.
8. Your Content
You retain ownership of all content you submit to ClearJob, including customer data, job records, photos, and documents. By using the service, you grant us a limited license to store, process, and display your content solely to provide the service to you.
You are responsible for ensuring you have the right to submit any content you upload and that your content does not violate any third-party rights.
9. Customer Data
You may enter personal information about your customers (names, phone numbers, email addresses) into ClearJob. You are responsible for handling this data in compliance with applicable privacy laws and for obtaining any necessary consents from your customers. 10. Intellectual Property
The ClearJob application, website, branding, and all associated intellectual property are owned by Brown Consulting LLC d/b/a ClearJob. Nothing in these Terms grants you any right to use our trademarks, logos, or other proprietary materials.
11. Disclaimers
ClearJob is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components.
ClearJob is a tool to help you manage your business. We are not responsible for the quality of work you perform, disputes with your customers, or any financial outcomes resulting from your use of the service.
12. Limitation of Liability
To the maximum extent permitted by law, ClearJob shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or your use of the service shall not exceed the amount you paid to ClearJob in the three months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless ClearJob and its owners, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the service, your content, your customer communications, or your violation of these Terms.
14. Termination
You may stop using ClearJob at any time. We may suspend or terminate your access to the service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
Upon termination, your right to use the service ceases. You may request a copy of your data before termination by contacting us.
15. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Florida.
16. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of ClearJob after changes are posted constitutes your acceptance.
